Just Culture Body

The just culture, established by regulation (EU) 376/2014, ensures protection of persons reporting safety events and of persons mentioned in such notifications.

In particular, staff members and persons under contract cannot be sanctioned by organisations for reporting safety events, except in case of gross negligence or deliberate breach of the rules. Likewise, a person mentioned in a safety notification cannot be sanctioned by their employer, except in case of gross negligence or deliberate breach of the rules.

What to do in the event of a breach of this protection of reporting persons and persons mentioned in the safety notifications?

Alleged violations of the just culture principles can be notified to the just culture body established for this purpose.

The mission of the just culture body is to receive and examine notifications of non-compliance with just culture. As it is not part of the hierarchical structure of the Directorate of Civil Aviation, it can maintain its impartiality. The body has an advisory role and makes recommendations to the Director of Civil Aviation and, where appropriate, to the Minister of Mobility and Public Works.

The just culture body is composed of 3 effective members and 3 alternate members, of which 2 members of the Directorate of Civil Aviation and 1 member of the Ministry of Mobility and Public Works. The just culture body may engage external experts if it deems necessary. The members and external experts are required to ensure the confidentiality of the information received.
